CONTRATO DE OFERTA DE SERVICIOS – MAESTROTOPIA
SERVICE AGREEMENT – MAESTROTOPIA
1. INTRODUCCIÓN / INTRODUCTION
Este documento constituye una oferta pública dirigida a los Usuarios de la plataforma Maestrotopia (en adelante, «la Plataforma»), propiedad y operada por Igor Yavlenin (en adelante, «el Titular»), Monotributista con CUIT disponible a solicitud del interesado.
This document constitutes a public offer directed to Users of the Maestrotopia platform (hereinafter, «the Platform»), owned and operated by Igor Yavlenin (hereinafter, «the Owner»), a Monotributo taxpayer, CUIT available upon request.
2. DEFINICIONES / DEFINITIONS
- Cliente / Client: Usuario que contrata un servicio mediante la Plataforma. / User contracting a service through the Platform.
- Prestador / Provider: Usuario que ofrece servicios mediante la Plataforma. / User offering services through the Platform.
- Comisión / Commission: Porcentaje del 14,69% retenido por la Plataforma sobre el monto total pagado por el Cliente. / Percentage of 14.69% withheld by the Platform from the total amount paid by the Client.
- Orden confirmada / Confirmed Order: Solicitud de servicio aceptada y pagada por el Cliente. / Service request accepted and paid by the Client.
3. OBJETO / PURPOSE
Regular la utilización de la Plataforma Maestrotopia, incluyendo la contratación, pago y prestación de servicios entre Clientes y Prestadores.
To regulate the use of the Maestrotopia Platform, including contracting, payment, and provision of services between Clients and Providers.
4. FUNCIONAMIENTO / FUNCTIONALITY
- El Cliente paga por adelantado el servicio solicitado mediante métodos disponibles (MercadoPago, transferencia bancaria).
The Client pays in advance for the requested service through available methods (MercadoPago, bank transfer). - La Plataforma retiene los fondos hasta que el Cliente confirme la prestación efectiva del servicio o transcurran 48 horas desde la fecha del servicio solicitado.
The Platform retains the funds until the Client confirms the effective provision of the service or until 48 hours have passed since the scheduled service date. - Tras confirmación o vencimiento del plazo, la Plataforma transfiere al Prestador el monto pagado menos la Comisión del 14,69%.
Upon confirmation or expiration of the term, the Platform transfers to the Provider the amount paid minus the 14.69% Commission. - La Plataforma emite al Prestador una factura tipo «C» por la comisión retenida.
The Platform issues to the Provider a type «C» invoice for the withheld commission.
5. RESPONSABILIDAD / LIABILITY
La Plataforma no es responsable por la calidad, contenido o resultados de los servicios prestados. Cualquier reclamo sobre el servicio debe resolverse directamente entre el Cliente y el Prestador.
The Platform is not responsible for the quality, content, or outcomes of the services provided. Any claims regarding services must be resolved directly between the Client and the Provider.
6. CANCELACIONES Y DEVOLUCIONES / CANCELLATIONS AND REFUNDS
Las cancelaciones deben comunicarse al menos con 24 horas de anticipación al inicio previsto del servicio. Solo habrá devoluciones en caso de que el servicio no sea prestado.
Cancellations must be communicated at least 24 hours before the scheduled start of the service. Refunds will only be processed if the service is not provided.
7. CONFIDENCIALIDAD Y DATOS PERSONALES / CONFIDENTIALITY AND PERSONAL DATA
La Plataforma cumple con la Ley Argentina 25.326 sobre protección de datos personales. Los datos son tratados según la Política de Privacidad publicada en el sitio web.
The Platform complies with Argentine Law 25.326 on personal data protection. Data are processed according to the Privacy Policy published on the website.
8. FACTURACIÓN Y DOCUMENTACIÓN / BILLING AND DOCUMENTATION
El Titular de la Plataforma emitirá facturas tipo «C» correspondientes a la comisión cobrada a los Prestadores. Los Prestadores serán responsables de cumplir con sus propias obligaciones fiscales.
The Platform Owner will issue type «C» invoices corresponding to the commission charged to Providers. Providers are responsible for complying with their own tax obligations.
9. LEGISLACIÓN APLICABLE Y JURISDICCIÓN / APPLICABLE LAW AND JURISDICTION
Este contrato se rige por las leyes vigentes de la República Argentina. Las partes se someten a la jurisdicción de los tribunales competentes en la Ciudad Autónoma de Buenos Aires.
This agreement is governed by the current laws of the Republic of Argentina. The parties submit to the jurisdiction of the competent courts in the Autonomous City of Buenos Aires.
10. ACEPTACIÓN / ACCEPTANCE
Al utilizar la Plataforma, los Usuarios declaran conocer y aceptar plenamente las condiciones expuestas en esta oferta pública.
By using the Platform, Users acknowledge and fully accept the conditions set forth in this public offer.
